Navigating CCMA & Employee Rights in South Africa

Adv. Sipho Ndlovu

Labour Relations Specialist

In South Africa, employee rights are robustly protected under the Labour Relations Act (LRA). However, many employees and employers are unsure of the correct steps to take when a workplace dispute arises. The Commission for Conciliation, Mediation and Arbitration (CCMA) serves as an independent body to resolve these issues fairly.

An unfair dismissal dispute must be referred to the CCMA within 30 days of the date of dismissal. If this window is missed, the applicant must apply for formal condonation, explaining the delay with valid justification.

The process typically begins with 'Conciliation'. This is an informal meeting where a commissioner attempts to help both parties reach a mutual agreement or settlement. No legal representation is generally allowed during conciliation, making it highly accessible and focused on amicable resolution.

If conciliation fails, the commissioner issues a certificate of non-resolution. The dispute can then be referred to 'Arbitration'. This is a more formal, court-like proceeding where both sides present evidence, cross-examine witnesses, and argue their case. Here, having legal cover and access to professional representation can be the difference between winning and losing your case.

Whether you are facing unfair dismissal, constructive dismissal, or unfair labour practices regarding promotions or suspension, knowing your rights is your strongest tool.

Key Takeaways for South Africans

  • You have exactly 30 days from the date of dismissal to refer an unfair dismissal case to the CCMA.
  • Conciliation is an informal, non-legal meeting to seek a compromise; arbitration is a formal hearing where evidence is officially ruled on.
  • The Basic Conditions of Employment Act (BCEA) establishes baseline rights for leave, working hours, and notice periods that cannot be overridden by employment contracts.
